UN Basic Operating Guidelines and Guiding Principles
United Nations Agencies Guiding Principles

  1. United Nations (UN) Agencies in Nepal and throughout the world are guided in their actions by principles and rules enshrined in international law including international humanitarian, human rights and refugee law and reflected in various resolutions adopted by the Member States of the United Nations. On this basis, UN Agencies are mandated to provide development and humanitarian assistance in times of peace and international as well as non-international armed conflict to civilian populations including but not limited to such vulnerable groups as women, children, the elderly, physically or mentally disabled persons, persons living with HIV/AIDS, internally displaced persons, refugees plus persons otherwise socially or economically disadvantaged or excluded. At all times, UN Agencies are to conduct their work in conformity with the principles of humanity, neutrality, impartiality, accountability and transparency, and in manner that respects, preserves and promotes the dignity and humanity of the people they seek to assist.

  2. In accordance with these principles and their common mandate, UN Agencies:

    1. provide assistance and protection to civilian populations on the basis of need alone and in a nondiscriminatory and equitable manner with respect to nationality, sex, race, ethnicity, caste, religion, political or ideological belief.

    2. uphold the right of these populations to receive such assistance and participate fully in development and humanitarian assistance programmes of which they are the intended stakeholders.

    3. recall their right to safe and unhindered access to civilian populations in need of assistance for purposes including but not limited to: the identification of needs; the formulation, monitoring and evaluation of development and humanitarian assistance programmes including programmes designed to reduce loss of life, human suffering and damage to property and/or the environment; informing the international community of the situation of stakeholder and other affected populations, and advocating for these populations' protection and assistance rights and requirements.

    4. stress that in the performance of their official duties, staff and associated personnel, whether national or international, employed by UN Agencies receive their instructions from the United Nations Secretary-General or his designated representatives and that, in this connection, national authorities and other entities, whether civilian or military, are called upon to facilitate the work of such staff and associated personnel in a constructive, positive and cooperative manner that ensures their safety, security, protection and freedom of movement in conformity with the relevant conventions and resolutions adopted by the Member States of the United Nations and in the spirit of international cooperation enshrined in the Charter of the United Nations. In this connection, United Nations and associated personnel are mindful of their obligation to respect the national laws of the country in which they are operating in accordance with international law and the Charter of the United Nations.

    5. emphasize that UN Agencies' development and humanitarian assistance in whatever form -- whether technical, financial or material -- is intended to develop, sustain and promote the social and economic well-being of civilian populations, including their physical and mental condition, and is in no form intended or to be used for, or in conjunction with, military, para -military, political or sectarian purposes or by groups and individuals affiliated with such purposes.

    6. recall that the Member States of the United Nations have agreed that within their respective territories they have the primary role in the initiation, organisation, coordination and implementation of development and humanitarian assistance; that they have the responsibility first and foremost to take care of the victims of emergencies; that for populations in need of development and humanitarian assistance, they are called upon to facilitate the work of UN Agencies in implementing such assistance; that intergovernmental organizations, nongovernmental organizations and certain non-State entities working impartially and with strictly humanitarian motives should continue to make a significant contribution in supplementing national efforts; that the sovereignty, territorial integrity and national unity of States must be fully respected in accordance with the Charter of the United Nations.
